EXTENSION ON CANADIAN STAY FOR THE TEMPORARY RESIDENTS

The residents who got a temporary stay permission in Canada and are stuck there due to covid-19 pandemic can now relax as IRCC has announced that the ones who have or are about to have an expired temporary residency status can now apply for extension. Yes, an extension that is more than the initial period which was granted.  The first step is to get this extension, a temporary resident needs to provide an application to IRCC that is why they cannot go back to their country and why they need to stay in canada? An online application followed by a standard biometrics fee will be asked by a candidate to get the process of extending their stay started. A temporary resident is suggested to apply for extension before the expiration of their permit. 

WHAT WILL HAPPEN IF YOUR STATUS ALREADY EXPIRED?

In this case, a candidate needs to file the application within 90 days to the IRCC to obtain an extension. There is a fee of 200 CAD associated with processing and restoration which needs to be paid beforehand.  The eligibility criteria for the extension does not carry much legalities. A candidate needs to be in canada with a valid temporary status from 30th January 2020 to 31st May 2021 and the expiration of their temporary resident permit has happened or is going to happen in this particular period of time. In addition to this, if the candidate is not able to fly back to his or her own country due to Covid-19 restrictions or anything else then they become eligible for this extension. Once the application is submitted to IRCC, a check is kept on the international flights. This is basically done to be sure that the temporary resident who applied for an extension really does not have the option to go back to his/her home country. The basic motive behind this step is to avoid false extension grants.  If the applicant is eligible for restoration an immigration officer will assess their application.  If the applicant meets all the requirements, the officer will issue a visitor record or the appropriate permit outlining the conditions for the restoration status. After that they will mail the document to the applicant. However, if the applicant is not eligible for restoration the Minister’s delegate decides on a disposition for the case. This could mean one of three things: the delegate will refer the case to an admissibility hearing; issue a departure order; or allow the foreign national to stay in Canada.
